Mesothelioma Lawsuit Filed

Carolyn Berry, wife of an auto mechanic, contracted mesothelioma, wrongfully caused by exposure to dust brought home on her husband's clothing. The lawsuit was filed Oct 23 on Madison County Circuit Court. The ongoing exposure runs from 1960 to 2003. They are seeking sums in excess of $100,000, punitive and exemplary damages in excess of $100,000, compensatory damages in excess of $100,000.

30,000 Asbestos Lawsuits

Ohio Supreme Court ruled laws relating to asbestos litigation will apply to cases pending when the laws were passed.

2004 laws imposed stricter rules on people suing for personal injury claims. After the Ohio Supreme Court ruling on asbestos, Cleveland county judges threw out over 30,000 asbestos related claims. The claims that were tossed were not serious, but if the individuals concerned develop something serious like mesothelioma, then the dismissed suits are free to be reinstated. Asymptomatic or undiagnosed plaintiffs would not be able to file a lawsuit on the basis of a degree of injury they do not currently have.
