30,000 Asbestos Lawsuits
Ohio Supreme Court ruled laws relating to asbestos litigation will apply to cases pending when the laws were passed.
2004 laws imposed stricter rules on people suing for personal injury claims. After the Ohio Supreme Court ruling on asbestos, Cleveland county judges threw out over 30,000 asbestos related claims. The claims that were tossed were not serious, but if the individuals concerned develop something serious like mesothelioma, then the dismissed suits are free to be reinstated. Asymptomatic or undiagnosed plaintiffs would not be able to file a lawsuit on the basis of a degree of injury they do not currently have.
